{"id":4584,"date":"2019-10-03T07:32:24","date_gmt":"2019-10-03T07:32:24","guid":{"rendered":"https:\/\/www.esithaklar.org\/?p=4584"},"modified":"2022-04-21T17:08:33","modified_gmt":"2022-04-21T14:08:33","slug":"reform-degil-tadilat","status":"publish","type":"post","link":"https:\/\/www.esithaklar.org\/eski\/2019\/10\/03\/reform-degil-tadilat\/","title":{"rendered":"Reform De\u011fil Tadilat!"},"content":{"rendered":"\n<h5 class=\"wp-block-heading\">ORTAK A\u00c7IKLAMA<\/h5>\n\n\n\n<h5 class=\"wp-block-heading\">2 EK\u0130M 2019<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\"><em>E\u015fit Haklar \u0130\u00e7in \u0130zleme Derne\u011fi, Hak \u0130nisiyatifi Derne\u011fi, \u0130nsan Haklar\u0131 Derne\u011fi, \u0130nsan Haklar\u0131 G\u00fcndemi Derne\u011fi, Yurtta\u015fl\u0131k Derne\u011fi<\/em><\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><em>Reform\nDe\u011fil Tadilat!<\/em><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Adalet Bakanl\u0131\u011f\u0131 taraf\u0131ndan\nhaz\u0131rlanarak 30 May\u0131s 2019 tarihinde kamuoyu ile payla\u015f\u0131lan Yarg\u0131 Reformu Strateji\nBelgesi \u00e7er\u00e7evesinde; iktidar partisi milletvekillerinin imzalar\u0131 ile 30 Eyl\u00fcl\n2019 g\u00fcn\u00fc Meclis Ba\u015fkanl\u0131\u011f\u0131\u2019na sunulan yasa de\u011fi\u015fikli\u011fi paketine ili\u015fkin g\u00f6r\u00fc\u015flerimizi\nkamuoyunun dikkatine sunmak istiyoruz. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00d6ncelikle belirtmek gerekir ki;\nbiz a\u015fa\u011f\u0131da imzas\u0131 olan Hak temelli \u00f6rg\u00fctler, detayl\u0131 olarak inceledi\u011fimiz yasa\nde\u011fi\u015fiklik metninde REFORM de\u011fil, ancak TAD\u0130LAT giri\u015fimi g\u00f6r\u00fcyoruz. Zira;\nvizyonunu \u201cg\u00fcven veren ve eri\u015filebilir bir adalet sistemi\u201d olarak belirledi\u011fini\nifade eden bir yakla\u015f\u0131m\u0131n, \u00f6ncelikle \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik hakk\u0131, d\u00fc\u015f\u00fcnce ve\nifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc, adil yarg\u0131lanma gibi hukuksal koruman\u0131n temel yap\u0131 ta\u015flar\u0131na\nuygun bir yap\u0131 in\u015fa etmesi gerekir ki, ger\u00e7ek anlamda bir reform olsun. Aksi\ntakdirde maalesef; sa\u011flam olmayan temeller \u00fczerine in\u015fa edilmi\u015f, s\u0131va\n\u00e7atlaklar\u0131 boyalarla kamufle edilen, dolay\u0131s\u0131yla amaca ve ihtiyaca cevap\nvermeyen bir yap\u0131 ile kar\u015f\u0131 kar\u015f\u0131yay\u0131z demektir.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Hakk\u0131nda soru\u015fturma, kovu\u015fturma ya da\nkesinle\u015fmi\u015f bir ceza h\u00fckm\u00fc olmayan KHK ma\u011fdurlar\u0131na \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131nca\nyeniden pasaport verilebilece\u011fi y\u00f6n\u00fcnde yap\u0131lacak d\u00fczenleme, malumun ilan\u0131\nniteli\u011findedir. Zira as\u0131l olan \u00f6zg\u00fcrl\u00fckt\u00fcr, ancak istisnai olarak ve yasa ile\nk\u0131s\u0131tlanabilir. <\/li><li>Ola\u011fan\u00fcst\u00fc\nHal d\u00f6neminde ortaya at\u0131lan ve ceza yasalar\u0131nda yer almayan \u201ciltisak\u201d ve \u201cirtibat\u201d\nkavramlar\u0131n\u0131n yasa metnine al\u0131nmalar\u0131, kanun yap\u0131m tekni\u011fine uymad\u0131\u011f\u0131 gibi\nhukuki de de\u011fildir.<\/li><li>Olmas\u0131\ngereken, KHK&#8217;lar\u0131 kanun haline getiren 7145 say\u0131l\u0131 kanunun d\u00fczeltilmesi ve gasp\nedilen haklar\u0131n do\u011frudan iadesidir.<\/li><li>Getirilmek\nistenen Hukuk Mesleklerine Giri\u015f S\u0131nav\u0131 hi\u00e7bir yaraya derman olmayaca\u011f\u0131 gibi,\nyeni sorunlara yol a\u00e7acakt\u0131r. Halen 100 civar\u0131nda Hukuk Fak\u00fcltesinde 50.000 \u2018in\n\u00fcst\u00fcnde hukuk fak\u00fcltesi \u00f6\u011frencisi \u00f6\u011frenimine devam etmektedir. \u00dclke \u00e7ap\u0131nda\navukat say\u0131s\u0131&nbsp;&nbsp; &nbsp;&nbsp;100.000\u2019den fazlad\u0131r. Ancak bir taraftan yeni\nfak\u00fclteler a\u00e7arken bir yandan s\u0131navla say\u0131y\u0131 s\u0131n\u0131rlamaya \u00e7al\u0131\u015fmak do\u011fru\nde\u011fildir. <\/li><li>Avukat\nsay\u0131s\u0131n\u0131n artmas\u0131 ya da mesleki kalitenin \u00f6l\u00e7\u00fcmlenmesi amac\u0131n\u0131 \u00f6ne s\u00fcrenlere\nan\u0131msatmak isteriz ki; \u00d6SYM taraf\u0131ndan yap\u0131lacak \u00e7oktan se\u00e7meli s\u0131navlarla\nancak bilgi \u00f6l\u00e7\u00fclebilir, avukatl\u0131k becerisi de\u011fil. Bu nedenle; var olan Hukuk\nFak\u00fcltelerinin aktif bir \u015fekilde denetlenmesi, \u00f6\u011fretim \u00fcyesi ve fiziki ko\u015fullar\nbak\u0131m\u0131ndan \u00f6l\u00e7\u00fclebilir standartlar belirlenerek bu standartlar\u0131n alt\u0131nda kalan\nfak\u00fcltelerin kapat\u0131lmalar\u0131 gerekmektedir. <\/li><li>Ter\u00f6rle\nM\u00fccadele Kanunun 7\/2. Maddesine \u201cHaber verme s\u0131n\u0131r\u0131n\u0131 a\u015fmayan veya ele\u015ftiri\namac\u0131yla yap\u0131lan d\u00fc\u015f\u00fcnce a\u00e7\u0131klamalar\u0131 su\u00e7 olu\u015fturmaz\u201d c\u00fcmlesinin eklenmesi\n\u00f6nerilmektedir. Evrensel hukuk \u00e7er\u00e7evesinde; ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn kapsam\u0131 zaten\nbudur. &nbsp;Yap\u0131lmas\u0131 gereken, demokrasi\n\u00f6n\u00fcnde engel te\u015fkil eden Ter\u00f6rle M\u00fccadele Kanunu&#8217;nu kald\u0131rmak, e\u011fer bu yap\u0131lam\u0131yorsa,\nilgili maddeye \u201ca\u00e7\u0131k\u00e7a \u015fiddeti \u00f6vme ya da destekleme\u201d k\u0131stas\u0131n\u0131 getirmektir. <\/li><li>Paketle\nT\u00fcrk Ceza Kanunu&#8217;nun 75.maddesine \u00f6n \u00f6deme kurumuyla ilgili bir ekleme\nyap\u0131lmaktad\u0131r. \u00d6n \u00f6demeye tabi su\u00e7lar\u0131n kapsam\u0131n\u0131 s\u0131n\u0131rl\u0131 olarak geni\u015fleten ve\n\u00f6n \u00f6demede taksitlendirme usul\u00fcn\u00fc getiren bu de\u011fi\u015fiklik olumlu olarak\nde\u011ferlendirilmektedir.<\/li><li>5271\nsay\u0131l\u0131 Ceza Muhakemesi Kanunu&#8217;nda yap\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclen de\u011fi\u015fiklik ile azami\ntutukluluk s\u00fcreleri belirlenmektedir. Ancak as\u0131l olan \u00f6zellikle \u201ckatalog\nsu\u00e7lar\u201d olarak bilinen ve CMK m.100&#8217;de say\u0131lan kimi su\u00e7lar s\u00f6z konusu oldu\u011funda\nadeta otomati\u011fe ba\u011flanm\u0131\u015f tutuklama usul\u00fcn\u00fcn terkedilmesidir. <\/li><li>Tutuklama\n\u015fartlar\u0131, her olay \u00f6zelinde hakim taraf\u0131ndan belirlenmek \u00fczere somut ka\u00e7ma\n\u015f\u00fcphesi ve delilleri karartma olas\u0131l\u0131\u011f\u0131 ile s\u0131n\u0131rlanmal\u0131, tutuklama kurumu pe\u015fin\nbir cezaland\u0131rma mekanizmas\u0131 olmaktan \u00e7\u0131kar\u0131lmal\u0131 ve ancak zorunlu hallerde\nba\u015fvurulan bir koruma tedbiri \u015fekline kavu\u015fturulmal\u0131d\u0131r.<\/li><li>Genelde\nt\u00fcm cinsel su\u00e7lar, \u00f6zelde ise cinsel sald\u0131r\u0131 ve cinsel istismar ma\u011fduru kad\u0131n\nve \u00e7ocuklarda ikincil travmalara neden olan ifade alma hususunda CMK m.236\nba\u011flam\u0131nda getirilmesi d\u00fc\u015f\u00fcn\u00fclen d\u00fczenlemeler, ama\u00e7sal olarak olumlu bulunsa da\nkad\u0131n haklar\u0131 ve \u00e7ocuk haklar\u0131 alanlar\u0131nda faaliyet g\u00f6steren sivil toplum\n\u00f6rg\u00fctlerinin g\u00f6r\u00fc\u015fleri mutlaka al\u0131nmal\u0131, uygulamadaki mu\u011flakl\u0131k giderilmelidir.\n<\/li><li>CMK\nm.250 ve 251&#8217;de yap\u0131lacak de\u011fi\u015fiklikler ile getirilmesi d\u00fc\u015f\u00fcn\u00fclen seri ve basit\nyarg\u0131lama usulleri konusu da dikkat \u00e7ekici niteliktedir. Her ne kadar, bu\nyarg\u0131lama usulleri ile g\u00f6rece basit su\u00e7lar a\u00e7\u0131s\u0131ndan yarg\u0131 makamlar\u0131n\u0131n y\u00fck\u00fcn\u00fcn\nazalt\u0131lmas\u0131 ve yarg\u0131lama s\u00fcrelerinin k\u0131salt\u0131lmas\u0131 ama\u00e7lanm\u0131\u015fsa da; bu\nde\u011fi\u015fikliklerin adil yarg\u0131lanma hakk\u0131 ba\u011flam\u0131nda savunma hakk\u0131n\u0131n k\u0131s\u0131tlanmas\u0131\nsonucu do\u011furmamas\u0131na \u00f6zen g\u00f6sterilmelidir. <\/li><li>\u0130stinaf\nve temyiz dengesi de tasla\u011f\u0131n dikkat \u00e7eken h\u00fck\u00fcmlerinden biridir. \u0130stinaf\nincelemesini, Yarg\u0131tay\u2019\u0131n i\u015f y\u00fck\u00fcn\u00fc azaltan ara form\u00fcl olarak lanse eden ve\nkovu\u015fturma s\u00fcrelerinin azalt\u0131lmas\u0131n\u0131 hedefledi\u011fini iddia eden siyasi yakla\u015f\u0131mla\nmevcut uygulamalar birbiri ile \u00e7eli\u015fmektedir.&nbsp;\n<\/li><li>Cumhuriyet\nGazetesi davas\u0131 \u00f6rne\u011finden hareketle, ayn\u0131 davada yarg\u0131lanan san\u0131klardan daha az\nceza alanlar\u0131n, temyiz s\u0131n\u0131r\u0131n\u0131n alt\u0131nda kalmas\u0131 nedeniyle, istinaf\ndenetiminden sonra cezalar\u0131 kesinle\u015ferek infaz edilmeye ba\u015flanm\u0131\u015ft\u0131r. Buna\nkar\u015f\u0131n, daha \u00e7ok ceza alanlar a\u00e7\u0131s\u0131ndan istinaf denetiminden sonra temyiz\ndenetimine yer verilmesi nedeniyle s\u00fcre\u00e7 hen\u00fcz devam etmektedir.
