G\u00fcncel tutuklu\nyarg\u0131lanma kararlar\u0131 geri \u00e7evrilmelidir. Hakimler gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fcnde adli\nkontrol ad\u0131na alternatif yollara ba\u015fvurmal\u0131d\u0131r. Benzer bir \u015fekilde, yeni\ntutuklananlar i\u00e7in tutuklu yarg\u0131lama bir se\u00e7enek olmamal\u0131d\u0131r. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Geli\u015fmekte olan\nCOVID-19 krizi hapishanelerde ve tutukevlerinde olas\u0131 bir salg\u0131n\u0131n \u00f6nlenmesi\ni\u00e7in gerekli tedbirlerin al\u0131nmas\u0131n\u0131 \u00f6ncelikli k\u0131l\u0131yor. D\u00fcnya Sa\u011fl\u0131k \u00d6rg\u00fct\u00fc\u2019n\u00fcn (WHO)\nbelirtti\u011fi \u00fczere \u201chapishaneler ve tutukevlerinde hastal\u0131\u011f\u0131n h\u0131zla yay\u0131lmas\u0131\nriski, hastal\u0131ktan etkilenen ki\u015fi say\u0131s\u0131n\u0131 s\u00fcratle art\u0131raca\u011f\u0131ndan, salg\u0131n\u0131n\nboyutunu b\u00fcy\u00fctecektir.\u201d<a href=\"#_ftn1\">[1]<\/a> Bir ba\u015fka deyi\u015fle\n\u201cCOVID-19 hastal\u0131\u011f\u0131n\u0131 kontrol alt\u0131nda tutmak i\u00e7in g\u00f6sterilen \u00e7abalar,\ncezaevleri de bu uygulamalara dahil edilmedi\u011fi s\u00fcrece muhtemelen ba\u015far\u0131s\u0131z\nolacakt\u0131r.\u201d <a href=\"#_ftn2\">[2]<\/a> Salg\u0131n riskini azaltmak i\u00e7in\nuluslararas\u0131 kurulu\u015flar\u0131n tavsiye etti\u011fi uygulamalardan biri parmakl\u0131klar\nard\u0131ndaki ki\u015filerin ayr\u0131m g\u00f6zetilmeden serbest b\u0131rak\u0131lmas\u0131d\u0131r.<a href=\"#_ftn3\">[3]<\/a> COVID-19 ile m\u00fccadelede\nkullan\u0131lan sosyal mesafe ve karantina gibi uygulamalar tutuklular\u0131n bulundu\u011fu\nyerlerde neredeyse imkans\u0131zd\u0131r ya da ba\u015fka olumsuz yan etkiler bar\u0131nd\u0131r\u0131r. Bu\nnedenle tutuklu bulunan ki\u015fi say\u0131s\u0131n\u0131 s\u0131n\u0131rlamak gerekmektedir. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">H\u00fck\u00fcmet \u0130nfaz\nKanunu\u2019nda de\u011fi\u015fiklik \u00f6ng\u00f6ren \u00dc\u00e7\u00fcnc\u00fc Yarg\u0131 Reformu Paketi haz\u0131rl\u0131klar\u0131n\u0131 zaten\ns\u00fcrd\u00fcr\u00fcrken, ge\u00e7en hafta Ceza ve G\u00fcvenlik Tedbirlerinin \u0130nfaz\u0131 Hakk\u0131nda Kanun\nile Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun Teklifi h\u0131zland\u0131r\u0131lm\u0131\u015f\nbir \u015fekilde T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019ne sunuldu. Bu teklifin 15 Nisan\n2020\u2019de yasala\u015farak y\u00fcr\u00fcrl\u00fc\u011fe girmesi ile birlikte h\u00fck\u00fcml\u00fc bulunan ki\u015fi\nsay\u0131s\u0131n\u0131n neredeyse \u00fc\u00e7te bir oran\u0131nda azalmas\u0131n\u0131n \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015ft\u0131r. T\u00fcrkiye\u2019de\nyakla\u015f\u0131k 294,000 ki\u015fi hapishanelerdeyken, 90,000 h\u00fck\u00fcml\u00fcn\u00fcn serbest b\u0131rak\u0131lmas\u0131\nBirle\u015fmi\u015f Milletler \u0130nsan Haklar\u0131 Y\u00fcksek Komiserli\u011fi\u2019nin \u201ch\u00fck\u00fcmetler ve ilgili makamlar,\ntutuklu-h\u00fck\u00fcml\u00fc bulunan ki\u015fi say\u0131s\u0131n\u0131 azaltmak i\u00e7in zaman kaybetmeden ad\u0131m\natmal\u0131\u201d \u00e7a\u011fr\u0131s\u0131na uygundur.<a href=\"#_ftn4\">[4]<\/a> \u0130nsan haklar\u0131 \u00f6rg\u00fctleri taraf\u0131ndan\nyap\u0131lan a\u00e7\u0131klamalarda da alt\u0131 \u00e7izildi\u011fi \u00fczere<a href=\"#_ftn5\">[5]<\/a> bu yasa de\u011fi\u015fikli\u011finin ayr\u0131m\ng\u00f6zetmeden daha geni\u015f bir \u00e7er\u00e7evede uygulanmamas\u0131, risk alt\u0131ndaki \u00f6zellikle de\nya\u015fl\u0131, altta yatan ba\u015fka hastal\u0131\u011f\u0131 veya rahats\u0131zl\u0131\u011f\u0131 bulunan ki\u015fileri\nkapsamamas\u0131 hayal k\u0131r\u0131kl\u0131\u011f\u0131 yaratm\u0131\u015ft\u0131r. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu yasa de\u011fi\u015fikli\u011fi\nsadece h\u00fck\u00fcml\u00fcleri kapsad\u0131\u011f\u0131ndan, bir ba\u015fka gruba, tutuklu yarg\u0131lanmakta olan binlerce\ninsana dikkat \u00e7ekmek istiyoruz. T\u00fcrkiye Cumhuriyeti Anayasas\u0131\u2019n\u0131n 13. Maddesi ve\nCeza Muhakemesi Kanunu\u2019nun 109. Maddesi soru\u015fturma a\u015famas\u0131nda tutuklama yerine adli\nkontrole \u00f6ncelik verilmesi gerekti\u011fini a\u00e7\u0131k\u00e7a belirtir. Benzer bir \u015fekilde\nAvrupa \u0130nsan Haklar\u0131 Mahkemesi kararlar\u0131n\u0131n da a\u00e7\u0131kl\u0131k getirdi\u011fi uluslararas\u0131\ninsan haklar\u0131 standartlar\u0131na g\u00f6re, masumiyet karinesi ve \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik\nhakk\u0131na dayanarak, tutuklu yarg\u0131lanmaya son \u00e7are olarak ba\u015fvurulmal\u0131d\u0131r. \u0130\u00e7inde\nbulundu\u011fumuz durumda bu arg\u00fcman acil olarak de\u011ferlendirilmelidir. Adalet\nBakanl\u0131\u011f\u0131 verilerine g\u00f6re cezaevlerindeki ki\u015filerin yakla\u015f\u0131k %43\u2019\u00fc tutuklu\nyarg\u0131lanmaktad\u0131r.<a href=\"#_ftn6\">[6]<\/a>\nBu veri dikkate al\u0131nd\u0131\u011f\u0131nda tutuklu yarg\u0131lananlar\u0131n say\u0131s\u0131n\u0131n azalt\u0131lmas\u0131\nsalg\u0131n riskini hafifletmeye \u00f6nemli bir katk\u0131 sa\u011flayabilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tutuklular\u0131n\ntahliyesi ancak bir hakimin bu y\u00f6nde karar vermesiyle m\u00fcmk\u00fcn olacakt\u0131r. Ceza Muhakemesi\nKanunu\u2019nun 109. Maddesi uyar\u0131nca hakimlerin tutuklular\u0131 adli kontrol alt\u0131nda\ntutarak serbest b\u0131rakma yetkisi vard\u0131r. (Kad\u0131na ve \u00e7ocu\u011fa kar\u015f\u0131 \u015fiddet su\u00e7undan\ntutuklu yarg\u0131lanan \u015f\u00fcpheliler\/san\u0131klar\u0131n\ntahliyesi s\u00f6z konusu oldu\u011funda 6284 say\u0131l\u0131 Ailenin Korunmas\u0131 ve Kad\u0131na Kar\u015f\u0131\n\u015eiddetin \u00d6nlenmesine Dair Kanunh\u00fck\u00fcmleri\ni\u015fletilmeli, \u015f\u00fcphelilerin\/san\u0131klar\u0131n ve ma\u011fdurlar\u0131n ayn\u0131 kapal\u0131 mekanda\nbulunmas\u0131 \u00f6nlenmeli ve ma\u011fdurlar\u0131n korunmas\u0131 i\u00e7in gerekli t\u00fcm \u00f6nlemler\nal\u0131nmal\u0131d\u0131r.) <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">COVID-19\n\u015fartlar\u0131 g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda bu istisna kural\u0131n ya\u015fam hakk\u0131 da dahil olmak\n\u00fczere ortaya \u00e7\u0131kabilecek her t\u00fcrl\u00fc risk g\u00f6z \u00f6n\u00fcne al\u0131narak de\u011ferlendirilmesi ve\nuygulanmas\u0131, savc\u0131l\u0131klar taraf\u0131ndan verilecek tutuklama sevk taleplerinin sona\nerdirilmesi ve Sulh Ceza Hakimlikleri taraf\u0131ndan verilecek tutuklama\nkararlar\u0131n\u0131n sona erdirilmesi gerekmektedir. Buna kar\u015f\u0131n tutuklama kararlar\u0131n\u0131n\nverilmeye devam ediyor olmas\u0131 bir\u00e7ok riski beraberinde getirmektedir.\nTutuklulu\u011fa sevk ve tutukluluk kararlar\u0131nda gerek Savc\u0131l\u0131k taraf\u0131ndan gerek\nSulh Ceza Hakimlikleri taraf\u0131ndan tutuklamaya alternatif olarak d\u00fczenlenen adli\nkontrol h\u00fck\u00fcmlerinin uygulanmas\u0131 i\u00e7inden ge\u00e7ti\u011fimiz s\u00fcre\u00e7 itibariyle elzemdir\nve hayati bir \u00f6neme sahiptir. Nitekim Adalet Bakanl\u0131\u011f\u0131 taraf\u0131ndan yap\u0131lan\na\u00e7\u0131klamaya g\u00f6re i\u00e7inde bulundu\u011fumuz hafta itibariyle cezaevlerinde bulunan\nki\u015filer COVID-19 salg\u0131n\u0131 nedeniyle ya\u015famlar\u0131n\u0131 yitirmeye ba\u015flam\u0131\u015flard\u0131r.<a href=\"#_ftn7\">[7]<\/a> Bu durum cezaevlerinde\nsalg\u0131n\u0131n ortaya \u00e7\u0131kt\u0131\u011f\u0131n\u0131n belirtisidir ve maalesef tablonun giderek daha k\u00f6t\u00fc\nbir hal alaca\u011f\u0131n\u0131n g\u00f6stergesidir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hakimler ve\nSavc\u0131lar Kurulu (HSK) pandemiye kar\u015f\u0131 \u00f6nlemler alarak duru\u015fma erteleme de dahil\nbaz\u0131 yetkileri mahkemelere devretmi\u015ftir. Tutuklu i\u015fleri bu erteleme kapsam\u0131nda\nyer almasa dahi, duru\u015fma tarihine kadar ge\u00e7ecek s\u00fcre hala tutuklular\u0131n ya\u015fam\nhaklar\u0131n\u0131n kar\u015f\u0131 kar\u015f\u0131ya oldu\u011fu pandemi kaynakl\u0131 riskleri art\u0131rma tehlikesi\nta\u015f\u0131maktad\u0131r. Bu perspektiften bak\u0131ld\u0131\u011f\u0131nda, tutuklu yarg\u0131lamalarda duru\u015fma\ng\u00fcn\u00fc beklenmeksizin tutuk incelemesi yap\u0131lmas\u0131 ve tutuklama yerine alternatif\nuygulamalar\u0131n y\u00fcr\u00fcrl\u00fc\u011fe sokulmas\u0131 b\u00fcy\u00fck \u00f6nem ta\u015f\u0131maktad\u0131r. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adil yarg\u0131lanma hakk\u0131 ve ayr\u0131mc\u0131l\u0131k yasa\u011f\u0131 ilkesi uyar\u0131nca, Avrupa \u0130\u015fkencenin ve \u0130nsanl\u0131k D\u0131\u015f\u0131 veya Onur K\u0131r\u0131c\u0131 Muamelenin veya Cezan\u0131n \u00d6nlenmesi Komitesi (CPT) \u00e7a\u011fr\u0131lar\u0131nda belirtildi\u011fi gibi, hakimlerin ellerinden geldi\u011fince \u201c\u00f6zg\u00fcrl\u00fckten mahrumiyete alternatifler bulmalar\u0131\u2026 Yetkili makamlar\u0131n tutuklu yarg\u0131lama alternatiflerini de\u011ferlendirmeleri\u2026\u201d<a href=\"#_ftn8\">[8]<\/a> \u00e7a\u011fr\u0131s\u0131nda bulunuyoruz. Biz, a\u015fa\u011f\u0131da imzas\u0131 olanlar, Hakimler ve Savc\u0131lar Kurulu\u2019nun yerel mahkemelere uluslararas\u0131 hukuka uygun bir bi\u00e7imde, prensip olarak tutuklu yarg\u0131lamadan ka\u00e7\u0131n\u0131lmas\u0131 y\u00f6n\u00fcnde yol g\u00f6stermesi \u00e7a\u011fr\u0131s\u0131nda bulunuyoruz. Bu, risklerin ve ya\u015fam hakk\u0131 ihlallerinin \u00f6n\u00fcne ge\u00e7ilmesi gereken pandemi ko\u015fullar\u0131nda daha da \u00f6nemli hale gelmi\u015f genel bir prensiptir.<\/p>\n\n\n\n<p
