Raporun i\u00e7eri\u011fi; DKAB dersi ve kitaplar\u0131n\u0131 bu haklar ba\u011flam\u0131nda yap\u0131sal, s\u00fcrece ili\u015fkin ve sonu\u00e7 g\u00f6stergeleri y\u00f6ntemi ile ortaya koyarak irdelemeyi ama\u00e7l\u0131yor ve T\u00fcrkiye\u2019nin uluslararas\u0131 ve ulusal hukuk y\u00fck\u00fcml\u00fcl\u00fckleri ve ilgili politikalar\u0131n geli\u015ftirilme s\u00fcre\u00e7lerini ele al\u0131yor.<\/p>\n\n\n\n<p>Ayr\u0131ca rapor kapsam\u0131nda 2018-2019 e\u011fitim \u00f6\u011fretim y\u0131l\u0131nda kullan\u0131lmaya ba\u015flanan DKAB ders kitaplar\u0131, tarafs\u0131z, nesnel ve kapsay\u0131c\u0131 olma, \u00e7ocu\u011fun din veya inan\u00e7 \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve ebeveynlerin \u00e7ocuklar\u0131n\u0131 kendi dini veya felsefi g\u00f6r\u00fc\u015fleri do\u011frultusunda yeti\u015ftirme hakk\u0131 a\u00e7\u0131s\u0131ndan de\u011ferlendiriliyor.<\/p>\n\n\n\n<p>DKAB dersine ili\u015fkin iki \u00f6nemli Avrupa \u0130nsan Haklar\u0131 Mahkemesi karar\u0131 ve bir\u00e7ok ulusal mahkeme karar\u0131 bu derslerin niteli\u011fi ve derslere ili\u015fkin tart\u0131\u015fma ve \u00e7al\u0131\u015fmalar a\u00e7\u0131s\u0131ndan \u00f6nem ta\u015f\u0131yor. Raporda yarg\u0131 kararlar\u0131na ili\u015fkin s\u00fcre\u00e7 de ayr\u0131nt\u0131l\u0131 bir \u015fekilde ele al\u0131n\u0131yor. De\u011ferlendirme DKAB ders kitaplar\u0131n\u0131n din k\u00fclt\u00fcr\u00fc veya dinler hakk\u0131nda e\u011fitim de\u011fil, din e\u011fitimi niteli\u011fini korudu\u011funu ortaya koyuyor. Ayr\u0131mc\u0131 olmayan ve insan haklar\u0131 hukukuyla uyumlu bir muafiyet mekanizmas\u0131n\u0131n bulunmamas\u0131 nedeniyle zorunlu din e\u011fitimi; hem \u00e7ocu\u011fun din veya inan\u00e7 \u00f6zg\u00fcrl\u00fc\u011f\u00fc, hem de ebeveynlerin \u00e7ocuklar\u0131n\u0131 kendi dini ve felsefi g\u00f6r\u00fc\u015fleri do\u011frultusunda yeti\u015ftirme hakk\u0131na ciddi bir m\u00fcdahale olu\u015fturuyor. Rapor kapsam\u0131nda incelenen protokoller, T\u00fcrkiye\u2019de hali haz\u0131rda tart\u0131\u015fmal\u0131 bir alan olan din ve e\u011fitim alan\u0131na, \u00f6zellikle \u00e7o\u011fulculuk, din veya inan\u00e7 \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve \u00e7ocuk haklar\u0131 bak\u0131m\u0131ndan incelenmesi gereken yeni bir boyut ekliyor. \u00d6te yandan, bu protokollerin ve etkinliklerin din e\u011fitimi i\u00e7in bir alan sa\u011flad\u0131\u011f\u0131na, bunun da \u00e7ocuklar\u0131n din veya inan\u00e7 \u00f6zg\u00fcrl\u00fc\u011f\u00fc ile \u00e7o\u011fulculuk a\u00e7\u0131s\u0131ndan \u00e7e\u015fitli sorunlar bar\u0131nd\u0131rd\u0131\u011f\u0131na ili\u015fkin dile getirilen g\u00f6zlemler ve \u00e7e\u015fitli gerek\u00e7elerle a\u00e7\u0131lan davalar da mevcut. \u00d6nemli bir b\u00f6l\u00fcm\u00fc \u201cde\u011ferler e\u011fitimi\u201d konulu olan protokollerin ve ilgili uygulamalar\u0131n incelenmesinde, e\u011fitimin ama\u00e7lar\u0131na, e\u011fitimde \u00e7o\u011fulculuk ve kapsay\u0131c\u0131l\u0131\u011fa, \u00e7ocu\u011fun din veya inan\u00e7 \u00f6zg\u00fcrl\u00fc\u011f\u00fcne, \u00e7ocu\u011fun kat\u0131l\u0131m hakk\u0131na ili\u015fkin insan haklar\u0131 norm ve standartlar\u0131 dayanak al\u0131n\u0131yor.
